Is Binance Authorised in Brazil? What the Central Bank Rules Say

Binance runs in Brazil through two local companies. Which one the Central Bank authorises, what changed on 27 Oct and what 6 Nov 2026 means for users.

Binance still serves Brazilian users, but not through one licence. Its own Brazil FAQ describes a two-company setup:

  • a local securities and FX broker that the Banco Central do Brasil (BCB) has authorised;
  • a separate local company, set up to provide the crypto services under the new BCB rules, which BCB data does not yet show as authorised.

The answer to "is Binance authorised?" depends on which company you mean and on what the BCB publishes after the 30 October 2026 filing deadline.

Which Binance Companies Operate in Brazil

According to Binance's support page "Binance Brasil: entenda as mudanças nos nossos serviços":

  • By 29 October 2026, every Brazilian user gets an individual payment account at Binance Brasil Corretora de Câmbio e Valores Mobiliários S.A. (formerly Sim;paul), CNPJ 68.757.681/0001-70. Real (BRL) operations and Pix run through this company.
  • The crypto services allowed by the rules are provided by BBrasil Sociedade Prestadora de Serviços de Ativos Virtuais Ltda., CNPJ 68.627.500/0001-91.
  • Customer crypto is held in custody by Nest Clearing and Custody Ltd., which Binance says is licensed by the Abu Dhabi FSRA.
  • Products that stay outside Brazil are run by Nest Exchange Limited in Abu Dhabi.

The broker (Binance Brasil Corretora) appears in the BCB's list of institutions authorised to operate in Brazil. You can confirm this yourself by searching the CNPJ in the BCB's "Encontre uma instituição" tool.

That authorisation is for a securities and FX broker. It is not an authorisation as a virtual-asset service provider (SPSAV) under Resolução BCB 520.

Is the Crypto Company Authorised?

Not yet, on the BCB's own data. Under Lei 14.478/2022 (art. 2), a virtual-asset service provider may operate in Brazil only with prior authorisation. Decreto 11.563/2023 gave that power to the BCB.

Resolução BCB 520 (in force since 2 February 2026) gave firms already active on that date 270 days to apply, which ended on 30 October 2026 (art. 88, I).

  • Firms that applied on time may keep operating until the BCB decides (art. 88, §6).
  • Firms that did not apply must stop within 30 days after the deadline (art. 88, §7).

As of 31 October 2026:

  • The BCB's open data on authorisation processes, latest reference date 30 September 2026, does not list any company as an authorised SPSAV.
  • That data also does not yet show BBrasil's application.

Binance's Brazil FAQ does not say whether BBrasil has applied for SPSAV authorisation. A filing made in October would first show up in BCB open data for the 31 October reference date, or in the BCB's transition list.

What Changed for Users on 27 October

Binance's FAQ lists what it stopped offering in Brazil from 27 October 2026:

  • Loans, Binance Pool, Cloud Mining, Margin, Launchpool, Megadrop, HODLer Airdrops and Alpha 2.0
  • 22 tokens delisted for Brazil: XVG, USDE, USTC, DCR, DUSK, PIVX, BB, MANTRA, ONE, GMT, TFUEL, ZIL, ONT, RVN, ACX, HIT, PYR, VANRY, VIC, ICX, SCRT and STORJ

Existing loan and margin positions can be reduced or closed but not increased. Binance says deposit addresses and trading history stay the same and identity checks migrate without a new KYC.

The FAQ also says that users who do not want to migrate can withdraw their assets and close the account. That is the only "exit" it describes. It does not announce that Binance is leaving Brazil.

What 6 November 2026 Means

From 6 November 2026, Resolução BCB 520 art. 91, as amended by Resolução BCB 589, bars banks, payment institutions and other BCB-authorised firms from carrying out or enabling crypto operations with virtual-asset providers that are "not authorised to operate in the country". The bar covers:

  • trading, intermediation and custody;
  • FX;
  • opening and keeping payment accounts;
  • payment transactions.

The BCB's vote approving the postponement (Voto 108/2026) says the extra week lets the BCB publish an official list of institutions in transition. That list covers:

  • providers that applied for authorisation;
  • eligible institutions that notified the BCB.

The vote does not say in so many words how firms on that list are treated under art. 91. That is the document to check for BBrasil once it is published.

Bottom line:

  • One Binance company is a BCB-authorised broker.
  • Binance's crypto business in Brazil is in the transition regime at best, not authorised.
  • Check the BCB's transition list and the "Encontre uma instituição" tool rather than any app banner.
